got cheated in Lucky Plaza ! Everyone come in & read !!

Just this morning, I was in a hurry to get a keyboard to hav my work done in Orchard cuz i forgot my old one in office. So i had no choice but had to buy one in Lucky plaza.

I went down to this shop at basement 1.

Actually, this was my 2nd purchase at this shop as I hav purchased another keyboard in this shop also.....like 1 month ago.

I paid S$ 40 for a mini-keyboard. Of cuz, i knew much more expensive than other shops in like Funan Mall and SLS. But I had no luxury of time and just decided to buy it in Lucky Plaza.

At the point of sale, the salesguy called "Jas" told me "If cannot work, can come back to shop.....can give u warranty.......life time some more..."

The item was in complete seal. Furthermore, he was saying...warranty & can come back if cannot work....and also I thought keyboards and mouses nowadays seldom got problem one......also, my other first time purchase was no problem.....

So, i just paid, got receipt and rushed back to my work place.

Then the story started......

I found.....the keyboard is not in working condition. Then i went back to the shop with receipt in less than an hour and the salesguy tested on his computer. Also it didnt work.

That is the time when the guy started showing his true character. He was the one who sold me but now he said...."srry who said got warranty.???.......no warranty cant exchange....where got written warranty.....if want exchange, pay another 28 S$..." (Which he was just simply trying to sell me another one, of cuz I do know can get a keyboard at S$14 in other shops like Funan.)

Then i told him....."When u sold me, u said "got warranty....not working...can come back also...". Then he replied......"Who knows I told u.... got warranty..." (which implies no witness, thus, he got rights to cheat.)

I told him..."ok, i will call Police.." then he said..."Call...call lor....go go...go outside my shop and call..."

Then I went up to Lucky Plaza's Security Office to report.....One officer was kind enough to tell me...."they cant help and get involved also....cuz shops are paying rentals...."(which implies shops are his employers...)

Furthermore, He was kind enough to tell me also "ya....here(Lucky Plaza) got a lot cheating shops...." and took out his cheating case record book (which i also saw a lot other cases)....and noted down my case. And he gave me police number to contact.

Then I reported to police, waited at security office and they came down to Lucky Plaza to investigate my case. B4 i brought them to the shop, they honestly explained to me....they cant force the shop to pay me back or exchange.

Then after police hav spoken to the salesguy, they also got told by the salesguy about the option of topping-up 28$ to get an exchange keyboard. I told Mr. Police that top-up to get exchange doesnt make sense cuz the seller can name any price. Then he said..."ya...the seller has the rights to sell any price he want."

Mr. Police was kind enough and told me..."In Singapore, it's like this........no black and white, cant help u......receipt also doesnt help.....cuz we also dont know either u or seller r saying the truth.......(which he referring to warranty or no warranty)....." and finally, issued me a report no. to call CASE.

I asked them how CASE can help me and only got told that CASE also can just talk between me and shop......they can't force also.....the most....they will blacklist the shop...."

Now, I'm thinking........ :think::think:

In first place, I didnt call police in the hope of forcing. I was just expecting to get justice..... at least...a refund......

From the sounds of what they said, "cant force" means "no way to help already".....

I willingly and knowingly paid double price of what a keyboard is really worth.....but when got faulty one, why the shop doesnt want to exchange even during 1 hr after sale??? :confused: That made me really frustrated.......

I vowed myself.....from today onwards, I will get "Blacks & Whites" on every single claim by shopseller in whatever items I buy in future in SINGAPORE, City of World Class Shopping Paradise............ :cry:
 

Lucky Plaza shops are for TOURISTS only... they know that tourists can't complain after they leave Singapore ...
local buy at your own risks! :dunno:
 

Lucky Plaza, Sim Lim Square, are those areas which one should avoid, unless one knows the shop very well or the shop is known to be reputable.
 

Let me give you some of my comments:

1. Obviously I don't need to tell you that in future you need to have it in black and white. If for some reason that cannot be done, activate the voice recording function in your mobile phone and record.

2. For the second trip, you could also have activated the voice recording function and record the guy trying to say "no witness, so too bad for you" - that would be good enough as evidence against him.

3. For the police, they can't really help you unless you can characterise it as a cheating case.

4. However, you can try the Small Claims Tribunal, where you need to pay S$10 to get your case heard. Provided that you have the evidence to show that the product was bought on X date, and you went there 1 hour later to say its faulty, chances are the court can find that the product was faulty when sold (rather than made faulty by you).

The shop may then say "no warranty". However, under the Sale of Goods Act, the product doesn't need to have any express warranty before you can claim under the provision that goods sold must be fit for purpose. A non-working keyboard obviously is not fit for purpose or of merchantable quality.

Hence, on a text book assessment of your case, assuming you can prove whatever you narrated here, I'd say you got a good chance legally to win the case.

Now, onto the practical assessment. Are you willing to spend S$10 and your time to bring the case to the SCT? That is for you to decide.

The problem with CASE is that from what I last heard, in order for them to help you, you need to join as member, and I recall at that time, it costs S$50 to join. Hence putting more people off.

On a final note, if you really feel buay gam, what you can do is to post your story onto as many forum boards as possible, and then print out the relevant threads/pages. Then go to the shop and tell them "Your shop has now made headlines in the Internet".

Of course, be prepared to prove what you say, or you might be exposed to a suit for defamation. Which is why my recommendation of voice recording always comes in useful.

Heya vince, I keep hearing my colleagues saying you can actually ask for a full refund if the product you purchase is faulty. Its our rights as a consumer. I dunno. What say you boss?

you go apple shop, go challenger also better than going random masak masak shop in lucky plaza

next time, die die go until funan or sim lim to get a keyboard, look at the receipt if it have a warranty clause.

else go to the nearest apple shop, probably at wheellock and get an apple keyboard...
 

Next time, be smarter. Check for a warrenty card, Insist on getting a warrenty card from the salesperson, or ask him to provide one that is handwritten with his particulars.

What brand is that keyboard? Some warranty you register online with model number. Thus...maybe you can try going to the keyboard maker's dealer or distributor directly for an exchange or for you to get a free repair on it....after telling them too your story.

I am also curious...why would you need a keyboard ...the place you work too stingy to provide everyone with one? heheheh...

In my view, you will have recourse if the product you purchased is faulty.

Recourse can come in the form of a full refund, or a replacement product. If they are not able to give you an immediate replacement, then I'd say that a full refund is in order (some shops like to play the waiting game by telling you no stock, must wait yada yada).

I would also like to add that the shop may also sometimes like to play the game of "find the manufacturer, not me". However, under the Sale of Goods Act, it is the shop that is responsible for the faulty product as it is the seller, not the manufacturer.

Also, not having a warranty does not preclude your rights under the Sale of Goods Act.

anyway, i think treat it as lesson learnt, but i dunno how much is 40 worth to you... sometimes this kinda things happen is to test our luck... since luck low, better dun test it anymore.

didnt know that apple got sell keyboard.....cuz i'm not apple fan and hardly go in and see inside apple shop. :embrass:

furthermore, my on-site servicing work didnt spare me much time to go up to Funan or SL...that's y decided to just get double-priced keyboard in lucky plaza. Didnt expect that the shop would chop me twice by selling faulty thing.......
