...the court ruling was for him to sell the matrimonial home (3room HDB flat) on the open market..

Your friend has no choice as to follow the court rule, to sell away the flat. He will be eligible to buy resale flat. He cannot repurchase the flat as the court rule said to sell the flat. As others said, get a agent to assist him.

yeah yr friend need to verify what did the court ruling said and what actually can be done. It is better to make a trip to Toa Payoh Hub , get a Q no and talk to the customer service officer.

Actually handling the buy sell procedure of a HDB flat is not difficult as it is so regulated by HDB. The agent is more useful for the marketing of the flat to find a buyer. Remember you need to pay 2% + GST of selling price as a seller for his commission. That is a few thousands dollars even for a 3room flat.

Thanks for all the responses! :)

He has (or actually I did... on his behalf) written a letter of appeal to HDB, requesting for HDB's permission to buy over his ex-wife's share of the flat, instead of him having to sell, buy, and then move, incurring unnecessary and heavy costs along the way.
They replied that this deal is agreeable with them, provided all the necessary paperwork (OTP, bank credit letter, etc) is done.

Yes will bring him down to HDB Branch Office first to see what can be done. Thanks!

The court has to agree with your friend to buy over his ex-wife's share of the flat else HDB will not approve his appeal. He has to settle with the court first.

oh.... that's going to be a bother...
ok thanks will inform him about that.

Yep, the court ruling needs to be amended first before HDB may act.

It appears from HDB letter that they agree to him buying over the part-share of the flat.

Anyway, they've also requested him to consult a solicitor with regards to the conveyancing matter, as they do not want to get involved (for whatever reason).
Any solicitor to recommend?

Does the conveyancing matter need the ex-wife to approve ?

spoke to a solicitor over the phone, and she mentioned the ex-wife needing to engage her own solicitor to act in this case.
am so confused! :dunno:
