Border seizures of laptops, cameras get Senate panel's scrutiny
WASHINGTON – U.S. border agents are copying and seizing the contents of laptops, cell phones and digital cameras from U.S. and foreign travelers entering the United States, witnesses told a Senate subcommittee Wednesday.

The extent of this practice is unknown despite requests to the Department of Homeland Security from the Senate Judiciary subcommittee on the Constitution and several nonprofit agencies.

The department also declined to send a representative to the hearing. Subcommittee Chairman Russ Feingold, D-Wis., said Homeland Security had told him that its "preferred" witness was unavailable Wednesday.

Feingold added that he had submitted written questions about the seizures of electronic data – and of some devices – to Homeland Security Secretary Michael Chertoff in April. Feingold said he's received no reply.

Chertoff's department provided a written statement that said it wasn't its intention to infringe on Americans' privacy but to protect the country from terrorists and criminals, whose electronic devices can reveal incriminating materials.

During border searches of laptops, according to the statement, the department's Customs and Border Protection officers have found "jihadist material, information about cyanide and nuclear material, video clips of improvised explosive devices being exploded, pictures of various high-level al-Qaida officials and other material associated with people seeking to do harm to the U.S. and its citizens."

Jayson Ahern, the deputy commissioner of Customs and Border Protection, signed the statement.

Some witnesses noted the 9th U.S. Circuit Court of Appeals in San Francisco had ruled in a recent child pornography case that federal agents could seize a laptop computer at the border without reasonable suspicion its owner was engaged in illegal activities.

However, several witnesses said that the ruling, by the most liberal of U.S. appeals courts, didn't end their concerns about Homeland Security's refusal to explain the standards for its searches, how it protects privacy, how the seized material is used and who can see or use it.

Three nonprofits – the Electronic Frontier Foundation, the Asian Law Caucus and the Association of Corporate Travel Executives – filed a Freedom of Information Act request last year seeking Homeland Security's answers to those questions. They've received none thus far.

They and other groups consider seizures made without probable cause to be an invasion of privacy that leaves the door open to ethnic and racial profiling.

Farhana Khera, president of Muslim Advocates, a San Francisco nonprofit, said her group had received complaints from Muslim, Arab and South Asian Americans. She said they also had been questioned about political, religious and personal views.

Retaining confidential computer files also worries business travelers and companies, said Susan Gurley, executive director of the Association of Corporate Travel Executives, based in Alexandria, Va.

They seem to be stopping a lot of U.S. citizens to check them first, according to what I've read elsewhere.

I'd imagine that they have long lines from Mexico, as they also have Border Patrol checkpoints that are quite a bit away from the border. I had a lengthy discussion with one agent in 2006 when I was driving north and west from El Paso, Texas. :bsmilie: I guess I look more Mexican than I am.

You'd better have a back up of everything on the computer, just in case they take it from you.

Oh, and I'd think that this won't be finished with a new president. Once these people get power, it takes a long time to let it go.

They are but some actually feel safer, for whatever reason.

The thing is that the FBI used to keep files on anyone and everyone. The Department of Homeland Security probably does similar things now.

In fact, a lot of things are similar to the 1970s. A president from Texas sent troops to fight in a war that was unnecessary. Many people were out of work. Corporate America had more power than private citizens. There was an oil crisis.

I hope that everything isn't repeated. The Democrat who replaced the Republican was pretty much powerless. The speed limit was artificially dropped. Corporate America was de-regulated in the name of competition that never really happened.
 

Anything will be better than Mr MC. While Republicans have the history of making new bold steps, mostly in conquring other countries, Democrats may actually help to hold the fort stronger and stop all the fighting. At least $ is not spent on MC's "good Lobby friendssss"

obama's already started to buck that trend. annoucning that he wasn't taking money from private donors was the right move to taking money out of politics. Also keep in min with the FBI it was Hoover who spearheaded all that. Once he was gone everything started to crumble and that man had his fair share of enemies. as per your 1970 reference history as we know goes in cycles. the erosion of america is inevitable and china will surpass them. really ironic when you think about it because thanks to bush america became very similar to isolationist imperial china.

the republicans represent the old antiquated guard using scare tactics to keep their fragile hold on power and money. the sooner they're gone the better. personally i think they corrupted everything lincoln ever stood for when he founded the republican party.

Just saw some even more disturbing news today.. US oil experts are claiming that the Arctic is holding 100 billion barrels of oil......... No prizes for guessing where the US carrier fleet is going to be headed to next.....

Don't they ever learn?? The arctic is one of the last untouched areas on the planet and they want to go build oil pumps and pollute it......

Jimmy Carter was one of the nicest people you could ever know and he said a lot of nice things and still does, but he was almost completely ineffective. Obama + Clinton is a viable presidency, but any other combination will make things worse.

sorry man no disrespect to the vets of vietnam, but its a distant memory compared to the more timely memory of the iraq bs. so if they want to get mad about their sons being sent to die, Iraq will be the galvanizing point for them. JC was ineffectual for a number of reasons. One of the big reasons why he didn't get reelected was because the economy tanked on his watch and he got blamed for it. But yes i agree Obama is untested as of now so could swing either way. But honestly anyone is better than the cowboy right now. and no the hardcore republicans hate mccain because he is too liberal for them which is why they wanted hilary to win because they knew alot of people would rather vote for mccain than hilary.

The irony is is that he was one of the hardest working presidents they've ever had while u see good ole dubya is also taking a vacation.
