So is he wrong for not reading the rules carefully?

Can contest organiser use photos for book?

RECENTLY, I was surprised to receive an e-mail message from the National Parks Board (NParks) inviting me to the launch of the commemorative book, Living In A Garden: The Greening Of Singapore, in recognition of my contribution to it.

I do not recall having contributed to this book. What I had done was participate in a series of photo competitions NParks organised in 2011/12.

I can accept that when I entered the competition, the organisers have the right to use my photos for publicity, exhibitions and other purposes related to the competition.

What I cannot accept is that the photos - especially those that did not win any prizes - now belong to the organiser, to be freely used for any subsequent project.

Regardless of the rules, it would have been basic courtesy for NParks to inform the competitors and seek their permission before using the photos.

Most of us probably do not mind. But there may be some who would not want their photos published as this bars them from submitting the photos for other competitions.

Uncle Fai... your thread topic is misleading. you make it sound as if they stole his images.

but yes, it's covered in the clauses that he grants NParks every right to reproduce his images, even if it's not in the context of the competition.

but they explicitly mentioned that he retains sole rights to use these images in other competitions, which he claims that he cannot do so.

just another guy with nothing better to do.

Wasn't Uncle Fai who started the topic, though I can see why you'd think it's him :D

Pretty much. If one disagrees with the terms, you're not forced to participate.

1. Entry/Eligibility
1a. This competition is open to Singapore citizens and all people residing in Singapore. All entrants must agree to abide by these terms and conditions. Only individual entries will be considered. Entry to this competition is free.

7. Organisers’ rights
7c. The organisers reserve the right to reproduce, display and distribute the photographs for publication, on an Internet Website and/or display in any media without obtaining further prior permission and payment of any fees to the photographer. Where any photograph is reproduced, the photographer will be credited.

8. Copyright Issues

The Organisers
8e. The Organisers reserve the non-exclusive right and royalty to reproduce, display, distribute and show the entrant’s submission for the following
purposes:
i. Operating, administering and promoting the competition;
ii. Displaying the entrant’s submission on this competition website and/or Sponsors’ website;
iii. Issuing a media release or making media pitches with images regarding winning entries;
iv. Usage of the entrant’s submission during our roadshows, exhibitions and in publications both printed and online.

Although looking at the way things are worded, it does make one wonder if the author of those terms deliberately left some ambiguity in, intending to mislead entrants who may not read extra carefully.

Clause 7 is quite general, using "any media". But while clauses 8e-i to 8e-iii restricts usage to competition-related purposes, the subsequent 8e-iv suddenly leaves out any mention of the competition. One might argue that a reasonable person would assume that the entire 8e specifies competition-related usage only.

I thought the terms were written so well (from the organizer's standpoint)... first claim all rights to use. Then smoke screen in 8 by saying competition only.. makes potential participants feel good about the contest... but 7c already got it all.

Nope, not credited, I guess.
I received a call from NParks today about the same thing, they apologized for using my photo without crediting it in their book,
but invited me for their commemorative dinner next Fri at SBG and said they will give me a complimentary copy of the book.

That is why don't anyhow join photo contest.

Seems like it is common nowadays for photo contest organizers to get free photos from this popular hobby. It robs the pros of their job, it robs the hobbyists of their rights. Even garmen statboard do this.

End of the day everyone unhappy.
