Got a request to use one of my photos for a campaign in the US by an agricultural department, to print on a wall. Was asked for the fee and usage rights.

What kinda fees usually apply (and how much?) and what paper work would be involved? Not sure how to proceed on this.

Appreciate any advice~

If you have not deal with this type of transaction, you might want to ask the interested party their price they are looking for.

If it fits your price, sell it, if not, move on.

However, you want to sell it so it is "Non-exclusive" rights for them so they can use it for their "purpose" but you don't give all your "copyright" away to them.

I hope this helps.

Regards,

Hart

In addition to non-exclusive usage (i.e. you still retain the rights & you can sell it to others), please put in restrictions on:
- time (how long they can use it for -- 1 year? 2 years?)
- media (only in print? online? TV?)

That should give you adequate protection.

However, do bear in mind not to negotiate & price yourself out of a deal. Unless, your shot is one-in-a-million that people are willing to pay good $$$ for.

Good luck :)

i agree with agetan

if you have never negotiated such a deal before, go with what they offer you. Take it If you are comfortable, if not just politely reject

normally for commercial usage, it has two criterial: the period of usage and the media as mentioned by nyxx88

nowadays the media is not limited to print(newspaper/magazines) and TV, not it also spreads to mobile media like bus/taxi etc.

otherwise you can sell it as a lump sum usage, then they can use it even after 10years and not limit to any media

Thanks for all the input guys. Yes first time getting such enquiries.. :p I've requested for more details from the interested party, kept options open.

May I also suggest that you ask for how large the image is going to be on the wall.

The reason is that the larger the image, the greater the presence, the higher the value.

BTW, is it alright for me to ask which agriculture dept? If it is the US Department of Agriculture, you can bet that you would be dealing like the garmen like that. Low price and want the copyright to the image.

Dont let anyone say otherwise.

ballpark figure is 1.5k-2.5k per image per media per year per country (or maybe per state).

Or 8000, within us states

Thanks for the input, yes it is the USDA. Got a feeling they were just looking for free pics though. :p
