Bounced cheaque

Hi People,

I am starting a new thread here seeking for help on a bounced cheaque in which my father received when he sold off his car. Subsequent agreed payment has been delayed again and again.

For your information, they signed the agreement on 31 Dec and till now, payment has not been received. I only got to know the whole matter yesterday and i called the buyer, telling him that if payment is not made today, i will proceed to take action.

May i ask, can i lodge a police report against the person based on the bounced cheaque and consider this as cheating? If not, any means to take any legal action against the person? Thanks in advance!

I am not legal trained, but based on what I know:
- A cheque is a promise to pay, and it's legally binding on the person who gives you the cheque.
So, yes, based on that, you should have a legal recourse to the person who issued the bounced cheque.

Thanks.. I feel better after hearing that. Hope payment is made today and save us all the hassles of making a report against him. Really pissed off with these people, trying to make a meal out of the elderly.

you must quickly go make a police report, take the police report and go LTA to stop
any further transfer of the vehicle ownership.

the case will get even more complicated if its transfered to another owner.

Cheque - you can only get your money if the person who issue it got enough money in the bank account. Bounced cheque = big trouble. This is NOT a criminal case, but a commercial case. Your recourse is to spend more money to hire a lawyer to fight it out in court. It means more money and time. In business, folks works on credit all the time, 60days payment, even 120days and so forth, writing off bad debts etc.

Cashier Order - yes, this is real money. The payer goes to the bank and ask for a cashier order in your name. The bank transfer the money to that piece of paper in your name - it is as good as cash in a piece of paper honoured by the bank. This is safe and secure. In other words, it is "cheque" issued by the bank, not by your creditor, who could default.

can you expose the buyer's name and contact, age, race and all other info
so that we can spread this news to potential seller to lookout.

You can only hope the person pay you back.
And if they do not, u can only go thru civil court to get it back.

But before that, think if the lawyer fees are worth it.
U can make a police report, i doubt the police can do anything about it.

I went thru the same thing, and lost almost 10K, though that idiot was in jail for a few months.

Latest update, received another cheaque from that person.
Amount: $11K. Hope it will got through this time.
 

if this guy has history of issueing bounce chq, dishonest chq, its a CBT case.
make police report and get it recorded for future reference. :thumbsup:

PERHAPS ... it might have been better to absolutely NOT accept ANY CHEQUES from this person.

For your information, issuing cheques that bounce due to insufficient funds, or any technical mistakes, such as figures and dates don't Telly, or wrong dates, etc... Will not land the issuers any trouble and is NOT a illegal or criminal offense.

It is only an offense if the account was closed, or if it is someone else cheques.

Get the seller to issue a cashier order from the bank instead of a cheque
:thumbsup: I would have ask for a cashier cheque when dealing with someone unknown and the amount is large. So, yeah, cashier cheque definitely if the first one bounced.
 

Thank you all for all the kind advices.

I have a hard time contacting him and he sent me the cheaque via a dispatch.
Dropped the cheaque last night and hopefully it will clear on Monday. Keep you guys posted. :)
