Need serious and urgent advice on my problems of tenants at my place

hi guys, really feel troubled. just wanna cut long story short. i have a condo at melville park rented out to pinoys bout 1 year ago. the contract is for the whole unit and for 2 years. They always ask for many ridiculous requests, pay not on time and some times pay half the amount.the house is rented out to 4 persons, but the contract is signed by a main tenant. So ultimately, my house is not rented out individually to 4 different persons but by a single entity. The big problem comes also when they keep changing the tenants inside there without letting us now. And initially there were 4 in the contract, currently there are 9 now in the house whom i do not know!!

that was the last straw, the agent helped us settle and the tenants decided to breach the contract and leave the house prematurely. so the initial 4 for rented out my place had to forfeit 2 months deposit that i was holding. But currently none of the original 4 are inside my place, 9 complete strangers are in there for this final month of august. They refuse to pick up my calls nor reply my sms. I asked them for their emails, they don't wanna give. Is is lawful that they refuse to give me their particulars?

The big qn now is that these 9 of them who are not inside my contract are staying inside my house. I am afraid that they might damage the house, not clean up my house before they leave..take away my tv..etc..

How do i combat this?i am sure they are capable of doing weird stuff as they are rather hostile to our presense. What should i do in such a situation for me to be secured?

huh?call the police?i mean..these 9 of them are like 3 adult ladies, 3 children and 3 men. All are working professionals.

Last night when i went down there to let them know about the last day to shift out..etc..they were quite dulan the face..

what should i do?

get all their particulars?

get some deposit from them (they surely won't wanna give)

or..?
 

you are the landlord. you can evict them. dont you have a clause of no sub-letting in the contract? if you dont have that then too bad.. your housing agent should be replaced for drawing such a weak contract for you.
 

how did you allow yourself to get into such a mess in the first place. Really have to be very firm eith the tenants. If you are not sure then seek an advice of a lawyer first
 

You could be jailed if they are illegal immigrants or over stayer. I suggest you seek your lawyer's advice first.
 

You should get them out asap...

Technically, the 9 did not rent the place from you, so TS, you have a right to evict them. Simple as that.
 

you mean you accepted rental from the 9 strangers? now, this is really messy!!!
otherwise it was so straight forward...you did not sign any contract with them...they are just trespassing into your private property...just call 999.
 

They are working professionals?? Then find out where they're working and call their boss!!

But best is call police.
 

yeah.. no contract, no stay.. you don't know what they can do to your place :eek:

just ask them nicely for the coming month that a contract need to be signed.. if not, they need to go.

I suggest you speak to your agent & get them out asap.

As tokrot has mentioned above, you could be in trouble if they are illegal immigrants since they have not given you any details or information. Best to put your foot down & get this sorted before matters blow out of control.

& 9 people in a apartment?? :bigeyes: How the hell did you let that happen? I used to stay at Meville, Simei right? Dont think the apartments there are suited for 9!

Snice u have already forfitted the deposit of the first original tenant n they are no longer around thats case leave it to rest.

Next for the 9 do u still want to carry on with this grp of tenants?
Talk to them nicely about ur situation sure they will understand n the problem can be solved. Everything / anything can be discuss and talk over. As landlord n tenants are not to make lives difficult for each other.

either
1) Evict them cos they were not the original tenants.

or

2) Maybe u will like to draft a new Tenancy Agreement (U can get a ur lawyer to draft or ur agt) with them.

If u decided to carry on with them make that this time round u got all their particulars n gt ur agent to do the due deligence check. Then u carry on with them.

Are they paying good rent money? Your neighbor may be annoyed and may report to police, you get investigated and if any of them found to be illegal you will be in trouble.
Is that trouble (may include police record) worth the rent money?

1. Go get the housing agent you originally talk to, if no more or dont want then look for new one and must be responsible and experienced one. If new explain the situation to him, you may have to pay him extra to get you out of this mess.
2. Arrange for a meeting and talk to these people, explain the situation and have a printed black and white of government regulation.
3. Give some time for them to settle elsewhere if you want to be nice, but be firm on the date. Get all of them to sign the agreement, and take pictures.
4. Be prepared that your property will be in a big mess once they left, may be with unpaid bills too.
 

If they do not have a valid permit/pass to stay in Singapore, it may get you into trouble. ignorance is not a defence. The Onus is on the owner to verify whether the tenant has a valid permit.

Wait they stay at your place in Simei, and you get to stay in government chalet with free food at Changi.

i suggest that after this, however it is settled, get a new housing agent.

they are precisely here to handle such problems, and nip it in the bud, not wait until it has grown into a monster, and then run around wringing their hands.
 

Your lawyer should be giving you advises and not us.

Also, be prepared some might be on illegal permit. If you are caught harboring illegal immigrants residing in your premise knowingly, you can get whipped by state law because you are the owner.

If your agent is aware and not doing anything, issue legal notice to drag your agent into the matter and make agent responsible for damages incurred.
