Recently saw an article in the Sunday Times.

I think schools used pictures of students on banners hang on the perimeter fence to do some publicity.

Is there a need for the school to ask permission for the pic on the banner?

What is the legal implication?
 

last time also dunno wats model release... nowadays ppl model release for even on school banners... next time do school annual also need model release for snapshots?

next time school yearbook..each student has to sign model release before class photos can be put in..:bsmilie:
 

No permission required because Singapore has yet to recognise the requirement for model releases, whether by judicial recognition, or by legislative creation.

The Hanis Hussey case was based on existing causes of action, namely defamation and copyright infringement (the ad agency and photographer assigned all rights to her), and not on model releases.

ask what/whose permission? students need to sign model release for their photos to be used on school banners?

1. The pic were taken by the school assigned photographer
2. The pic were taken within the school compound
3. The students were in school uniform

I dont' think any of these factors are relevant when assessing whether a model release is required. Compelling moral reasons though not necessarily legal factors.

Then if in the case for example, the Newpaper Big Walk or what ever event that is open to public. You are not the official photographer, but you taken a photo of a person during that event, which you feel the expression and composition is an award winning piece. So can you still use this photo for contest? How to get "model" release (if required) when you don't even know who and where this person stay?
If the photo get published by the contest organiser. will the photographer or the organiser get into trouble if the person in the photo came shouting at the contest organiser to demand for some money (or whatever) for usage of "his face" in the photos?
I know there is nothing wrong to take photo of any person in public, but using these photos for contest, webs publish, or even post in CS for comments and sharing.... anything legally wrong with that?

my friend actually warn me from taking pictures of stranger to submit for photo competition. He said i might be sued but the person in the photo and this was stated in the law! But i can't find anything abt this law here. :dunno:

am i right to say, if the photo competition stated model release in T&C, we hv to follow?

As with the case with most photographers in CS , they surf the web to try to find answers. And the web ianswers they find usualyl relates to US websites or US books or US forums; and hence the advice they go away with is hte US position; which is probably not applicable in Singapore. Laws differe significantly from jurisdiction to jurisdictino, and even in the US, each state has its own set of laws.

Until within the last few years where I tried very hard to educate people on model releases, everyone thought they are required in Singapore. I was the only person who said the world was round when everyone thought it was flat...but over time it appears that there is a slow, but surely changing view.

For the last question, well yes, you have to comply just so as to follow their T&Cs. Its like they say "please submit in 8R" or "please attach JPG, no TIFs, PSDs" etc, - it is just an internal requirement.
