leaking toilet ceiling? who pay?

hi people,

I have a leaking toilet ceiling. After removing the false ceiling, we have determined that it is leaking from a pipe from the above unit, ie, everytime the above unit drain water from their toilet, my ceiling leaks.

So in this kind of scenario, who should pay for the repairs?

The unit above, me or 50-50?

It could be 50-50. HDB? 5 yrs ago it happened to my toilet. Water sip through and wet teh concrete over time that is cause a chunk to fall off. and part of the metal structure was rusted. Ask neighbour what they want to do about it to solve this. As usual, drag their feet and act blur like it was not their doing. After making a report to HDB to ask them, they told both home owners that the cost will be shared 50-50 and the contractor was someone HDB contact to do the repair so no one can claim the other might be pulling a fast one to cheat the other of over charging or paying less. I thought it was fair that way.

My house also like this.... But it's not a definite project coz the waterproofing can shift the problem elsewhere....
 

50-50 but complain abit more u get to pay 50 of the 50.

Previously, used to be 50-50. Now under new legislation, the unit causing the problem pays. In this case, your top floor neighbour pay 100%.

I just did the repair last month for cost of $1600, HDB subsidise 50%, top floor and us paid the other 50% still $400. I still wonder is the cost of $1600 a fair price...
 

when was the legislation effective? why did hdb subsidizes?

I tried googling and searching hdb website but cannot find it.
 

Just contact yr town council, the will come and see and arrange with hdb. I think the subsidise is by the town council just guessing bcos I heard my MP need to sign the approval. I did the 2 toilet last yr new floor, toilet and sink cost me only $700+ each I wonder why the ceiling need to cost $1600... inflated for the 'subsidise'??? Hope not.
 

how come so exp?
did my masterbed room 5 years ago and 2nd toilet 2 years ago. They just inject some compound in the ceilling. About 200? Needless to say my neighbour above me has no "love" for my family ha...

It depends, if its a newly renovated house then the people upstairs have to pay, if its not then it's 50% HDB, 25% each (upstairs and downstairs). but some might need to get the MP to sign the approval.

I just did my kitchen celing, the town council found that its a old problem, so i need to pay the 25%.

Call your town council and get them to check it first, they will advise you what to do next.

Why does town council involve ? It should be HDB responsible.
 

In general there are 2 kinds of leaks, 1 is the waterpipe burst or water drip out from small holes, the other is the upper unit floor sealing give way. If waterpipe burst, the contractor need to locate where is the burst then need to block it and re-route it, if floor sealing give way, then the upper unit need to remove the toilet floor tiles, re-do the sealing layer, then re-put back the floor tiles. I am not sure which leaks is TS case but look like he has both problems.
 

Make a call to HDB, they will send someone down to inspect the situation. The person will tell u the outcome. Mostly HDB will play 50%, u n the other half 25% each. But u must see MP to write in. I know cause I helped my mum recently. She currently not staying in the house but her tenant complain leaking. In the end, my mum pays ard $200 for it but repair works done on the upper floor. :thumbsup:

I live in EC so not under HDB ruling. Anyway, the management council say the top guy will pay for everything so I am getting my contractor down to quote today.

$1600 so expensive. My management council says should be around 200-300... Let's see how expensive it is...
