Hi all

I know this may not be the right place to post this, but this is to reach the nikon community about unethical sellers on this forum

I agreed to a price offered by user Terzeto for a SB800 and we arranged to meet. However on today when we were suppose to meet and view, i got a message that he had a higher bid so will backed out of our deal.

I think we need to enforce the rules of reservation as a good ethic and practice. I just want to make this known to the Nikon community here of such an occurrence. Should the new buyer read this, this is not your fault as all is transparent to you, but just to let you know this seller had bounced our agreed price to you to bid higher, when he already had an agreement with me

First time i encounter such an instance here. :angry: btw this user has somehow disappeared from the member list...

My view is that
Ethics are principles and standards that guide our behaviour towards others. ( taken from my HRM notes)
You either have it or not.
This person is only unethical but what he is doing is legal.
So i guess there is nothing you can do about it.
Wait for a better deal i guess.

I agree there is nothing illegal. Nevertheless we don't always conduct ourselves by law, so that's why there is a set of ethics

THe only loophole in entering into such agreements here is that we really need to rely on trust between buyer and seller, as there is no written agreement in black and white.

My experience here has always been good with me in both seller and buyer roles. The general public is honest and ethical.

Just my luck this time. :bheart: And just hope to let the new buyer know that he/she is buying from a seller with a lower sense of ethics than the general public
 

most of the time sellers expect the potential buyers to honour their bid price and not lowball them after meeting up.
but sometimes once the seller agreed to sell you, on your part to play safe dont believe that the seller will 100% honour the deal with you.
who knows he might last min back out like in your case.
just take it easy...at least the seller didnt fly aeroplane on you which means he still put in the effort to inform you last min unlike some of the blacklisted sellers over in hardwarezone.
gd thing is that you never part with your $$$.

but seriously some of the new members here be it sellers/buyers with single/double digit postings, i find it a bit hard to really trust their words.
like recently i got a deal with this seller (with single digit posting), provided me with an "old" filter with the lens he's selling, he didnt make an honest effort to inform me that the filter is slightly scratched on the surface.
with no pics of his lens, i expect his lens to be cleaner than my kit lens cos he said in his WTS thread that his lens have never left the house, turns out the lens barrel is quite dusty.
he as a seller on his part, could have make a decent effort to blow away the dust spec but he didnt.

should have bargin with him about the filter and lower my paying price.
sadly i did my part as a buyer but he didnt as a seller.
and they tend to be in a rush to sell their items away as well.
 

In contract law, once there is an offer and an agreement, the contract is sealed and binding. There is also no need for a written agreement and verbal is also legally binding.

Unfortunately, in disputes, it becomes dificult to hold anyone to a verbal agreement. Such is the caveat of buy-sell forums...

What most pissed me is that this seller terzeto has removed his post and even his membership... dubious people who just zip in and out then conduct under table negotiations

As buyers, i think we should insist on open bidding and reservation of goods, then proper closure of the thread

There are all kinds of people in tis world...the good and the bad. When u meet tis bad seller, take it with a pinch of salt.You will appreciate more when the good seller comes along.In fact, some turn out to be friends after the sale.. so dun let tis bad experience affect the way u feel for most sellers ya..;)

it's a bummer to meet with this kind of situation. there's nothing wrong for the seller wanting a higher price for his item but to 'fly kite' on you this way is unethical. he should at least given you an opportunity to counter bid or meet up with you and see if the deal goes through. if it goes through, he has at least fulfilled his obligation as a responsible seller. if it doesn't, he can talk to the next bid. right now, if the higher bid fly kite on him, it's his retribution.

as for missing from the members list, what's there to stop him from registering with another nick.

i had quite a few buyers fly kite on me about three months ago. so these fellas are blacklisted in my record. take it easy. look for another deal.

i believe sellers can provide reasonable reasoning to as why they are selling their stuff at this price but buyers who offer reasons to as why they cant buy the item at seller's mentioned price is simply nonsense...if cant pay so much, then bid lower loh.
simple logic...no money then dont buy.
since photography is not really a cheap hobby in the 1st place.

but dont lowball until it reaches an unresonable price.
at least on your part as a buyer make sure you find out more about the 2nd hand market rate before bidding.
thats why i always indicate in my WTS thread, no lowballers please !
and they would stay away from my thread liao.

dont ever think about lowballing me cos i'm already selling my lens at the lowest possible 2nd hand market rate.
any lower as a seller, i feel is damaging the pricing for other similar 2nd hand lens.

It's up to the individual to decide his spending habits. A student can be poor but own a great deal of material possessions (or perhaps that is why they are "poor"). Notwithstanding, that should not be used as an excuse to lower a previously agreed upon price.
 

the best customers according to shops are the students. they come in with parents money or their savings to get what they need.

working folks come in and bargain even to get a $10 discount.

this is what a lot of my friends working in retail tell me.
 

i sold items in the B&S before and similarly had another guy offer me more than my BNP after i've agreed to sell cheaper to another guy. i told the former sorry it's sold. i'd rather keep my integrity than to earn an extra couple of bucks. whether its legally binding or not, its all a question of ethics. and yes, i agree on the students being easier customers scenario. most of us do our homework and check prices before going to the shops. whats the point of haggling over a few dollars? sometimes simple mathematics will tell u that its cheaper to buy at a slightly more ex shop close to you than to travel to an out-of-the-way shop that offers it alil cheaper.
 

Whether it is legal depends on how he represented to the buyer.

If he said "okay sold to you", then later change his mind, it is "not legal".

If he said "okay, I'll tenatively sell to you, but if some other guy comes along I can sell to him, or I can sell anyone I like without first telling you", then it is legal.

However, buyer's who hear the second version will then be able to adjust their expectation and may very well buy another one somewhere else for whatever reason. Hence expectations are managed.

At least he inform you..
I got a few cases never inform at all... never p/u call & never reply sms..
Luckily the deal point is near my place, just wasted my time only..:eek:
 

Thanks for all the feedback. I know i may like to gripe but one point I think all agree on is that such behavior should not be condoned nor encouraged. I may have started this thread as a complaint, but then again i realized that exposing such behavior and condemning them is the least that ethical buyers & sellers alike can do to minimize future occurrences

To terzeto ("real name" stated as Alicia. I will refrain from showing your hp), just my luck to chance upon you, and probably just your luck you met a vocal person such as me. Believe you me, if there were more ways to make you public, I would love to, if not to enforce what is ethical, then at least to satiate my anger. For now I guess you can continue to hide behind the anonymity of the internet until u decide to surface with another user name to sell photo eqpt on clubsnap

PS: just to clarify, this is by far the only bad experience here i had. All my previous buying and selling experiences were great and with honest friendly people, some of whom have connected to my network
 

oh and just to add...

I did not give a low price as some might think. my price is clubsnap market rate for a <2year SB800, and hadactually been jacked up by terzeto from another bid. I hope the first bidder had not been stood up like me
 

Lol dont even need to post HP number, he/she already posted himself/herself
