Thread: Timeshare Scam!! Anyone of you in it too?

    ERI?...well there's a few such companies in orchard...there's one in that office where UOB is beneath it in somerset...called ATC...well, i pissed off the manager there he he...he showed me the door.

    Been to ERI myself...went in and come out immediately.

    do not sign anything ... cos they will not let you have much time to read the contract.

    as for you...complain liao...cos that's the best you can do now...

    sometime greed plays a big part on the suckee. If they dont covet the freebies they would not be sucked of their money.

    hi siron,
    really sorry to hear your story and experience. I remember seeing this same case happened and broadcast in channel 8 long time ago...but now I can't remember how the story ends.

    Not that I can help, but some curious questions:
    1. How much have you paid in total?
    2. You have all the official receipt?
    3. You intended to get back your money or just want to drop and forget the case?

    sigh... i really feel sorry for those teenages and fresh graduates on orchard conning people into wasting their time at such timeshare sessions. They get cursed and sworn at by us, while their bosses make the bulk of the money. Why does the government allow such things?

    last time i also got this call and i told them i still schooling they immediately say....'are u mr xx' i said no then they say got wrong number

You mean M1, Starhub and Singtel can give number out like that? Anyway then I thought why not going down listen to some presentation wouldn't hurt and further more I have free gifts.

    So I went down with my girlfriend, went to the reception, check my name, and a friendly lady came out and greet us, talk to us in a very professional ways, in no time she was like a friend to us! She told us to enter the room but reminded us to switch off our phones. Sited down she introduce someone to us, I think it was her boss. Anyway tidbits and drinks were served to us, making us feel comfortable. So there she go, sharing with us all the holidays resort that they deals with, it was easily a 4 or 5 hours session that we had to sit through. Her boss joined us and talked to us too. Anyway they put it in a way that was so good. They were very persuasive. I wanted to leave but they kept holding us back. Promised us that this thing can even be an investment that it will NOT depreciate in value that I could sell it away when I wanted and make monies from it. It was a long day, we were very tired, we thought okay, we might be interested if the price is good. But it was $19,000!! We were shocked!! Then they told us payment can be very affordable, that they could work out an installment plan for us that we can easily afford!! But They we were have to put a deposit $3000, But we said we could not come out that much, but the lady said, let me check with my boss, she went away for a while and returned and said, you guys are very lucky!! For you we can take just $1000 as deposit!! I told them I needed time to consider this. But they kept holding us back and said, its only for today that we can offer you this, not even tomorrow! Tomorrow will be a different price and I can tell you it would be higher!! After being in the office for a long 5 hours or so, our minds was like Okay. Since that we signed,13th of April 2002. That was the time I know things were all wrong.

    How stupid was my then girlfriend and myself to actually sign on the dotted line and that stupid bell rang!! Gosh I must have been so stupid then!!

    Anyway we realized this is nothing but a scam, we called them up and wanted to cancel the so called membership, but they said we can't as stated in the contract!! I was like what!?? I can't?? Is there such a clause in the contract!?? We were not even aware of that! When we bought that thing, we thought we could sell it off!! That was what we were told!! But on the phone, he said only when you paid up in FULL. I was so pissed off!! I even told them we were willing to for-go all that we had paid!! But he said, you must understand, what you are paying was only 20% of the whole ownership, we had to source out the other 80% for you from investors. If you were to give up! what happen to the 80% upfront paid for you!??Anyway lastly he said that its in BLACK & WHITE as signed by us in the contract. Sigh....Anyway we didn't want to let this be a burden to us, so we actually lower the installment from $300 a month to $150 a month. We knew it was going no where but we were so helpless. So we continued to pay the $150 a month till somewhere we decided that was it!! We do not want to carry on anymore, especially after reading so many bad publicity towards this timeshare scam. Enough is enough. we are not going to let our hard earned money be wasted into something that we don't even use! Or I put it CAN'T even use. So we defaulted the payments from 03rd July 2002 onwards.

    On the15th August 2003, we received a letter from ERI stated that if we do not make the payments within 7 days, they would pass this case to their legal department and we would be deal with in accordance with the contractual terms. We choose to ignored.

    On the 28th September 2004, we received another letter from ERI stating that " Please be informed that you have been in arrears of $16,200 being the total outstanding amount due for the purchase of the said agreement." And that if we do not pay in FULL or PARTIAL payment from us, they would not hesitate to instruct their Legal Department to institute the legal proceeding against us to recover the monies due to them.

    I really want to put an END to all these nightmare, I can choose it ignore it once again, but I know that someday it will still be resurface. Thus I am desperately seeking help to end this nightmare, furthermore I am no longer with my partner whom I signed this agreement with.

    And I heard that CASE cannot do much regarding this issue although there had been countless complaints against Timeshare companies.

    Please do help me and end this once and for all.

    If you think you do need not be responsible for signing the contract, then fight the case in court. Unless they put a gun on your head when you signed it.
    I too, slam the phone when I get these calls. Or better still, say yes and don't turn up.

    The thing is that one of my friend had tried CASE and its of no use...they could not do much, I've checked on the net too, they can't do much from what they say. Hmmmm.... I'll hope I can settle it real soon!! So stressful!! hmmmm

    Putting myself into your shoes, I will stop payment immediately.

    Want to charge me court? Bring it on, baby. I will answer the summons to court.

    If they have the gall to charge me, they will have to answer to the judge. Contract in black and white? I will insist, in court and under sworn oath, on signing the contract under duress. Afterall, this is just a tactic to scare me into avoiding legal problems. I'm not afraid. Like I said earlier - bring it on.

    What's more if the company is not a registered company, it is even more suspect.

    My opinion is that the government is stop all this time-share and MLM companies on thriving from people's greed. It's just plain wrong.

    Nothing is for free.

    Steven, take my advice... bring them to court. Strike first.

    Based on my limited knowledge of contract law, a contract need not be equal as long as it is willing buyer and willing seller.

    The best approach for you is to gather few people who are in the same shoe like you and must be buyer from the same company, you can then start the legal battle with the basis that the contract was signed under the influence of mis-representation and pressure. If a few of you who come from difference background and do not know each other before testify the same way in court you are likely to win the case.

    The first obsticle is to gather enough people, once you are able to start the legal battle, it is likely that they will want to sattle out of court because they don't want such case to blow up where there will be more people who are suffering in silence to joint you.

    Since you are able to start this forum, you should be able to sign up more local forum and post the same issue, you should also state that you are gathering people in you same shoe, you can also try to call up the news paper hopefully you may pick up one editor who wants to write your story. You can also put up an advertisement in The Streats Time Classify stating you are looking for time sharing owner from xxx company.

    You have to be determine and thinking out of box to get yourself out of such trouble.

    Any Lawer here who can give advice??

    Hey sirion, sorry to hear about this horrible mess you're in.

    As you pointed that going to CASE is an avenue for recourse, why don't give their office a visit? Inform them in detail of your situation.

    I strongly feel that as a watchdog body for the local consumers, CASE must make clear their stand on this timshare 'scam'. CASE is established to hear and protect the consumers. So, as consumers we have to make it a point that we do not accept if they tell us "there's nothing we can do about it"... {HELLO... what are you around for in the first place?} There definitely IS something that can be done by CASE.

    I suggest you write in to Streats or Today Forum. The media coverage is so wide, someone may be able to help. Straits time can be considered too. Its also a good media to share with the rest of people not fully aware of such scheme.

    If you are SAFRA member, there is a free legal consultation once a month. Make appointment 1st.

    If not, perhaps you can go Small Claim Tribunal to check 1st, maybe you can "strike" them before they take "legal" action against you.

    Check if the Unfair Trading Act covers situation like yours.

    one more advice, if you've really spoke to CASE and they mentioned that CASE cannot render any help to you, remember to state that in the FORUM, must say that even CASE can't help you and you are in mental and financial despair and would like to know which authority you can turn to.

    Your chance of getting help will be higher...most likely the Head of CASE will reply and you may get aone more chance from them to help you.

    1) Join CASE
    2) Ensure that the person you talk to said it can't be help
    3) Write a good letter to forum, do not be long, concise and clear. Few paragraph will do.

    sorry to sound harsh, but you don't really have a case against ERI. did they dishonour any part of their agreement? were u denied the use of your timeshare? all you did was to regret buying it ("buyer's regret") and want to cancel the contract. in fact, you even defaulted on payments, simply because the company had "bad publicity". if you want to get out of this situation legally, you need to build up a strong case for yourself, e.g. quantify and prove what damages you have suffered as a result of this "scam". then you will a better chance of success.

    you can buy better gear but you can't buy a better eye

    That I have to agree on what you said too, but really if you read my story, it was that pressure that thay gave us...that can't leave unless you sign thing. I know its all free will, But there are alot of mis-representation when selling their products, Its like they will whack anything juz to sell off their timeshare. Ya know what I mean? Right now I am gathering some people...or rather I am joining some grp, hopefully we can do something abt it real soon. I really hate to drag this matter, but thank You guys!!
