Question Photo Wanted(OT)

I was doing my CS reading late night, and came across the "Photo Wanted(local)" thread.

Seems like there are a few interesting issues that photographers should look into.
Maybe my question seems stupid, but would appreciate some advice, etc.


1) Senario 1,
When you cover an event, the photos usually goes to the party that hires you. And they can do whatever they want with it, (i.e. pass on to other organization, publish in mag(with or without acknowledgement?)?
Any legal implication here?
Or rather, what is the usual?

2)Senario 2,
When someone(maybe friends) ask for photos to be used for their own publication or website, what are the limitation?
Should we enter a proper written agreement to prevent any misunderstanding down the line?

3)Finally,
when you DO sell your photos, is it possible to retain the copyright, and restrict the buyer to limited usage?
If so, how much does a photo sell??

I also see mention about royalty, which maybe in the form of %profit, etc right? Is this a common practise among local commercial photographer?



Pardon me for my long list of queries, just thought that having a discussion of such would be fruitful, especially I'm sure many photographers are unsure of the above answers too, unless they deal with photography in a more commercial way.

its all down to negotiating...if u dun mind them having full rights to it WITHOUT GIVING U ACKNOWLEDGEMENT, then its okay, but professional behaviour and business ethics will credit u no matter what.... its the payment that is more tricky. for eg. i'd restrict their usage of the images to the confined issue of magazine/newsletter as per agreement between the 2 parties. Any images found circulating in other areas/other mags or anything deviating from the prior agreement will mean breach of contract and liable to legalities.

Again u must ALWAYS have BLACK AND WHITE!!!!!!!! if its a very very special close friend (read, gf, close girl friends and the likes) u may feel compelled to do it FOC.....which is okay, but still, must have a prior understanding and best if its written down to limit usage. ultimately if things turn ugly later, ur ass is covered! u can, read all 3 answers...its all down to NEGOTIATIONS and BLACK AND WHITES. how much a photo sells depends on how good your photo is lar!

Generally, i notice that there are some blacksheep here who are either genuinely quite ignorant of FINE PRINTS and ethics or they just wanna undermine the market. Even some seasoned fellas also fall trap to a NON BLACK AND WHITE agreements ....coz based on "trust" and crap.......

my take is, whether u are a close friend, stranger or heck, even relatives, black and whites and prior agreements are IMPT!
