Default Selling Usage Rights of Photo

    Dear friends,

I have been made an offer for usage rights of a photo in Japan for three years, for a pet food company's corporate material.

Would anyone have advice as to how I should quote or what I should consider in creating a contract and quoting?

Thank you! I appreciate your advice.

Have requested for a draft contract, and am consulting my lawyer.

Anybody who has experience in this able to advise on the ballpark figure for rate to offer?

Depends on the size of the picture - and what is corporate materials? Print only, or also internet. Do they want exclusivity?

On Getty they would pay anywhere from 50 USD to up to 1000 USD. Probably a too wide band for you to be helpful.

OK - charge 300 USD - and be happy, close the deal and get the money.

    hello btrenkel,

Thank you so much for your reply to my queries, and for giving me a ballpark figure for what Getty - an industry leader - offers.

"Depends on the size of the picture - and what is corporate materials? Print only, or also internet. Do they want exclusivity?"
    - I have asked for the details concerning where and how the image will be used, and what are their terms for exclusivity. I have also asked about the company's background and standing, as a further gauge of market value.

What about size of image? Mine is 8MP, and I'd like to know what considerations I'd have to make, and how it affects my rate.

Thanks for your help and kind attention!

you should look at American Society for Media Professional's website.

Personally, if someone were to approach me with this, I would ask for about US$2k if it is going to go international on top of what is mentioned.

8 MP is considered these days 'medium/large' size, nothing very big.

You can go on Getty, register, and browse a bit around. I think some pictures might even show pricing. That gives you also an idea.

However, if you go to the other spectrum - microstock. This would be an 'extended license'. See istockphoto, and check licenses. And the client would pay ~100 USD, but you would only get 20-30% of it. 30$.

My previous suggestion of 300 USD is probably reasonable. If you go to high, they might look somewhere else. And bet you - there are real stunning pictures out there, which cost less than 300$. If you get them to pay this - take it.

If you're charging 300 bucks, then don't bother with the lawyer.
