    Default Record Company's Copyrights.(Legal chat)

Hi all.not even sure if this thread is in the right place,if not,Admins n Mods, pls move it.

I was @ an autograph session held by a record company. Was very surprised to hear from the DJ saying that the company does not allow any form of videography n professional photography at all as reason stated was that the company owns all copyrights.another reason is they say photographers r selling the pics....
The event was held in a shopping mall where everyone and anyone can see n hear the event..

How is it that they hold "all copyrights" is what interests me.if i record a show via tv to watch on a later date,do they have copyrights on that recorded show?? sounds weird, right?that alone just sounds funny to me.

Most of the photofraphers take these events for personal use or pics to share with others via forums/websites/blog.unless stated by the record company @ the event itself(as stated above what happened)i guess selling of the pics is ok??

what r ur thoughts on the matter?

    I love legal chats hehe

Under the law, copyright belongs to the person who took the photograph. It does not matter what they say - these managers or DJs like to make up their own laws to get people to do what they want, in the same way security guards like to make up laws to stop people from tkaing photographs.

They do not hold any copyright. It does not matter whether you take for personal use or commerical use or whatever use - copyright belongs to you, period. As I said, they can say anything they like, whether it has legal effect or is legally enforceable is another quesiton altogehter.

Many such "bullies" like to prey on the typical layman's ignorance of the law, to bully them into doing what they want. They know they can't do anythign tos top people from taking photos, and yet they do not want poeple taking photos for their own commercial reasons - hence they invent all sorts of plausible sounding laws to achieve their objectives.

If I were you, jsut ignore them. If you want to go on the offensive, tell them you are going to take the photos and see what they can do about it.

The most they can do is to call building management to evict you from the place, but by the time that happens, the event would hvae been over. Even if that happens, you get to keep every single photo you have shot up till that point.

zoossh and i were talking about it n we do agree that they cant ask us to stop if we r outside of the event area n only the building management can do so.

Hmm, if it is photography related, it may be a good idea to have a thread on it, so that everyone can discuss and share ideas. And also others can benefit from the exchange of ideas.

However, if it really is a very private affair, sure you can pm me, although I prefer you email me instead (see my email in the thread linked in my sig).

Erm, yes, as a matter of fact, they do - since they made it. Wrong analogy, right?

But the claim about them holding copyright over photos taken in a public event in a public place is silly. Obviously in this case, you own the copyright. Sigh, the things they say to prevent photography. They shouldn't hold it in a public space then if they didn't want any chance of people taking pictures.
