Default Bad Payment Experience

I think many may have experiences on Bad payment after job was delivered..

Sometimes in March I had a D&D shoot for an event company. But I was running a fever on that day, i managed to get someone from CS forum to cover me..

The shoot was done and delivered to me in good shape.. I handed over to this event company's person in-charge and requested COD.. he add blur and gave me a cheque issue by his company and i banked in. But few days later I recieved a bounced cheque advise from the bank. I called up this guy and he added blur claiming he not aware.. he promised to pay me in few days time.. but i have no news from him. I started calling and sms him, the was trying to aviod by saying busy, sick, etc giving all craps of excuses.

until a day I called him and he promised to pay me.. I fixed an appointment with him and waited for half an hour till he arrived. he issued me another post dated cheque.. b4 the day of the dated cheque, he sms me to bank in another week later cos he said no $$ in the bank! he assure will pay me. so i banked in a week later.. guess what? bounced again!!

Till now he still has not pay me yet! he is still giving crab excuses and pushing later and later date! I have paid the guy who covered me!

An event company dont even has few hundred dollars in the bank? what company is that?!!

I bring this out is hopes that u guys will be careful with this kind of company. caution!

Anyway, I may report this to the police.

Bro,

I've taken a pte ltd company to small claims as a freelance entity and won the case.
We should not let this kind of scums get away.

Just name the company for the benefits of follow bros here since you're the current victim.
There's no way that the company can sue u in turn for that.

BTW, 1 bounced cheque is already a good evidence for bad-business & non-payment to services rendered, and 2nd bounced cheque may make a 'bad-business-deal' to an intended fraud which is criminal. (depends on the hands of which lawyer and how far you want to push it.)

I would say, for the benefit of others here, name the company.

Name the company . No point cover up as he won't pay you by hook or by crook. And he will never pay you as the job was completed.

hi,
I am just wondering if that particular staff who engaged me avoiding payment or his company.. wonder his boss aware of it. I am going to call up the boss on Monday to find out the reality. and will go to small claim if they deny payment..

i oso think is good to let all of u know so as to avoid taking up any job from them or atleast be careful if want to deal with them..

let me find out the reality whether is the company or that particular employee problem first.

hmmm.. wonder is there a list of blacklisted agencies for references to benefit all especially to the freelancers here?

It would be good to keep copies of the cheque and bounced back advice.

If I recall (and seriously subject to confirmation), intentionally issuing a dud cheque is a criminal offence.

can be charged for fraud.

problem is.... he can write you a official cheque.

and later he can call up bank and cancel the cheque.

like this way... he is not chargable for any offence. and he can cook up any story to make sure you do not get the money. because he has the right to cancel that cheque.

but if that piece of cheque he gave bounced. you can charge him for fraud or cheat case too...

Hi Jensen,

The blacklist is available at CASE. So far this is only civil suit case for small claims tribunal unless you can prove that the bounced cheque is issued with intend to cheat.

If its the company that is giving the problem instead of the employee, you can also go to CASE to report about this company.

You can always start a blacklist here in ClubSnap.

Perhaps we should all agree on 1 strict policy...
Cash on delivery.

As cameraman, 1st jobs I always request for COD....payment on delivery of footage tape.
No payment, no footage tape.
Until at a point when the job request is regular enuff, then I will allow the company to make me a 14days term on payment.

As editor, same policy....no payment, no delivery of final video.
But in the event of going to someone's facility to edit, i will always have my own timesheet where the hiring company will have to sign in and sign out to verify my working hours if it's a working relationship.

This policy where I have been religiously following have greatly reduce my pain in chasing payments & I stop worrying about my accounting matters.

And I have another strict policy, which is to pay the camera guys I hire on time too.
Because if I don't want this kind of things to happen to myself, likewise I don't want the people who work for me to feel the same way.

What we do is to make the client sign a contract and collect a $200 or 20% deposit prior to the job. It will bound the client to pay on time. Even though verbal agreement still stands in court but "black & white" still somehow has a bigger impact to getting payment in time.

Only people who pay in 3months is the Govt Depts due to the paper work process thru the finance depts.

BTW guys do list out or mention any late payment companies or guys lets collate a list and help each other yah. Its hard to survive in S'pore nowadays, we have to band together as video production professionals.

Agreed....We don't have unions, professional bodies and associations to help us, so it's only thru unity that we can help one another in this area of business..

Well same for any market - there will be clients who dun pay. My strategic partner who is a photographer got a customer (who is the neighbour of their studio) a Pte Ltd company gave them a bounce chq of $400 then close the shop and run away.

Like I mentioned earlier, draft a contract. Biz is Biz - fren is fren. Once the client sign the contract he know very well that he is bounded by the terms & conditions stipulated in the contract.

I emailed CASE enquiring on any industry standards for videography/ production companies but they dun have any see their reply :

Apologies for the late response. ASAS looks at issues of advertising standards, e.g. whether an ad is misleading or offensive. We are unable to provide guidance on customer service and price standards.
