    well there are always holes in the law and there always will be.

    but point 1 is a general statement but point 2 has stated special situation of which the situation now is falling under.

    the only way the studio can retain the ownership will have to be in the contract.
    sigh.

    it's exactly in the 'exceptions' that the copyright of the pictures can be for the gentleman that started this thread.

    Ya i think u r right, nevermind.
    Think its on the onus of the customer to state the terms and conditions on the contract.

    Just confused abt "I pay money to have my pics taken, but i dun get to retain the pics" ruling.

    Was in the same situation as a bride years back. The bridal shop was extending its showroom space and wanted to have more portraits on display on the walls. We really didn't like the idea at all, and they only asked for our permission when the pictures are out. So, we told the bridal shop how we felt and said "If put our pictures up, have to pay us $xxxx (can't remember how much at all, just anyhow quote so that she won't pursue the idea) .." Made the Lao Ban Niang angry, but we were firm on our stand.

    My advice: They will try to sweet talk you into agreeing to do it for free, but we are consumers/customers too. This is also not what we expect when getting their services. My husband and I are always careful with all the fine prints, and definitely would not have signed a contract that allow them to use our pictures when engaging them. So, she can fume, we just don't agree.
