Well, technically they are a charity... They don't have much funds... guess this is a way to raise them...

I don't think they'll get many entries from CSers though...

I totally concur, which is why I'm all for raising awareness.

I agree about raising awareness. To be honest I'm not against some of the rules and will still participate in some of these competitions, but I believe everyone should enter with an understanding of the rules. (That is why these rules were put up in the first place, for us to read.)

I feels that they should make those winning entry their ownership, then for the rest, return the ownership to the photographer. Isn't this fairer?

I would think most of the time, it should be this way. I remember someone complained to URA for their terms and condition last time and yes!, they did changed their T&C...

anyway, I have dropped them a note asking them to review clause No.9 on their terms and conditions.

I have also placed a link to this tread for them to read.
Lets hope that something good comes out of it.

One of the key staff in STP is actually a member of CS ..........sorry wont mention who.

He's a fair enough guy and I'm sure he will see this thread.

Anyway, I m for what the bro above said about the organizers having rights over the winning images.

If the T&C are like what it is now, I might as well start a stock photo agency and organize a photo competition every month/quarter with a different theme that clients are looking for and dangle a couple thousands dollars worth of photo equiptment in exchange for literally thousands of images. Acquisition cost is very low per image

was not free to check this thread till this morning.
To those who think "if you're happy join, if not, don't join.", "no point bringing up the same old issues again here", if you take a step back and look at all these postings, in this thread and others relating to copyrights, don't you think awareness HAVE been created? Every thread like this that have genarated discussation, will have at least 1 CSer who's unaware of it in the first place, till he/she reads what we've raised and start to realise that the T&Cs are not as what he thought it to be. That in itself, is worth spending time here discussing the matter.

This would help those who are not in the know (ie newbies, who are born every minute, or even oldbies who may not realise the legal implications).

Greater awareness would also mean that the participants, before joining, know what they are getting themselves into, and then, make an informed decision whether to join or not.

Of course, we can say, like you join, don't like you don't join. But why can't we also say, don't like and lets talk about it. Thats the very nature of a forums - to discuss

If anything, this creates greater awareness on the topic rather than just hushing it away and saying "buyer beware, you want you buy, you dont want you don't buy". Such a mentality will only result in the greater ability by the organisers or whoever to set T&Cs which are increasingly weighted against the participants.

As this competitions thing start to gain more awareness, perhaps then some progress can be made to try to make the terms more equitable - in fact, who knows, the organiers may go "hmm how come last 5 years eveyrone join, then recently like less and less pple join, and now I even have to give the first prize to this crappy shot...".

Of course, this is not certain, but what can be certain is, if there is no discussion or awareness, there will be further ingrained in the industry, these set of supposedly standard terms. By then, it will really be take it or leave it (see insurance T&Cs, Banks and credit card T&Cs - they are so weighted against hte consumer simply becuase their industry might has made them able to do it - and also a lot of consumers don't read these terms and only know about them when there's a problem)
    very well said!!!!

Have been following this thread and others about the T&C. Have to thank those who brought it up and made me aware of the T&C issues.

I am probably going to get flamed for writing this, but how is bringing up this topic time and again in all these contest threads different from printing "Smoking can cause cancer" on the cigarette boxes? It makes more people aware of the harmfulness of smoking, some might even quit smoking, but does it stop the cigarette companies from selling more cigarettes and making more $?

Similarly, why should companies that organizes photo competition with such T&C want to change their T&C if it still benefits them? Just because we read these posts and a few decided not to join competition because of this, means the companies will change their T&C? So easy, so simple?

For those who are really very concern about the T&C, why not take it a step or 2 further (eg. start a petition, etc), instead of repeating this T&C discussion again and again in these threads?

Guess i just added more fuel for further discussion

don't worry about being flame or adding fuel to the issue. Everyone have a right to state their point of view.

Well, for your info, some of us have taken it a step further. Some have written in to the org, inform them about this thread, request them to relook their T&C, etc.

Agreed with what you have said, they'll NOT change their T&Cs just because of one or two person/postings, BUT, this is a start, if we can create more awareness, more and more people here start to demand more respect for their images, org will have to sit up and take a 2nd look at how they do things, if less people take part in their competation, winning shots are crap ( as is already happening ), the same people are always at the competation, org have to take notice.

For the time being now, what we can hope to achive is, at least those who want to take part in competations, are aware of what the T&Cs may entail. If they still want to join, well good luck to them and may the best shot win. But at least they go in with their eyes open. Do not under estimate the power of the internet.

I went back to look at their T&C again...

They will not be holding on to the photo copyright, the participants hold it, just that they are allow to use the photo(s) and the participants are not allow to tranfer this copyright to other party.(point 11)

Participants have to grant STB a royalty-free and non-exclusive licence to use the copyright and all other intellectual property rights of whatever nature in such Photographs.(point 9)

Pt 11 bullet 2 is saying that, you are the sole owner of the IPR of the photograph, and is entitled to assign the IPR to STB.

Sorry if I fail to write it sensibly, but your interpretation is wrg.
