It's true... Confuse me on our Singapore Legal system... The EXACT same pirated DVD sold in China for 6RMB is now being sold in singapore shops for SG$16... with Censorshop sticker !!! Comes complete with typo errors and below average box and DVD print.

Can someone tell me how the heck we gonna tell the difference with what's right and what's wrong???

I was at a video rental place recently and i saw them sticking the censorship labels on the DVD covers themselves. I think the government just issues them to the distributors and sellers and let them stick it on. Probably some irresponsible people stole some and used it on the pirated discs or even made copies of the stickers. Can't blame the government as it is not possible for them to stick the labels onto every discs themselves.

Key point: use your head lor. It's normally easy to tell if they are originals or fake. you yourself mentioned some key points. although i heard some software pirates are trying to pass off fakes as originals by using nice boxes and fake holo stickers. be careful!

While the gahmen sa kas the West by clamping down on piracy for 80 cents, it has forgotten that the East is where the problem lies. You can dl a sub from an American but it will be the East Asians that will package it and call it their own. Support free fansubs!!!! If govt can't do anything, we shouldn't allow such vcd shops to get away with it! Stop buying from those that conduct illegal activitgies. I know many korean drama buffs won't like it...

Those may not be fakes, they are parallel imports DVD from China...They are legal copies in China, but I am not sure whether they remain legal out of China...

look at the the back of the DVD cover, normally it is clearly stated it is produced in China with license from original producer...

A censors sticker just means that it has gone through censorship. I'm not sure that the Board of Film Censors authenticates to make sure that they are legitimate and not pirated copies.

This trick has been used by pirates since quite a few years ago to trick the public to thinking the DVD/VCDs are genuine - its not a new trick.

In Singapore there is no distinction between fake and original with the censorship sticker.
From what I know censorship board only censor the movie not distinguish it between fake or not. You could also have a sticker on your own home made movie or what so ever. If you bring in DVD that are not censored, they will just ask you to send to censorship board for the sticker. Not sure about the price but that is it. In short they don't care as long as you pay.

if i'm not wrong, vendors just have to tell Censorship board they have imported xx amount of title xxx dvds, and since the dvds have been seen to be of standard, they can just get stickers to stick them, need not bring the physical goods down for verification.

Censorship Board Sticker != Mark of Authenticity

    BUT

Censorship Board Sticker = Mark that it had the proper rating and that its 'safe' for sale and public viewing without elements of extreme deciepting explicit, gore, sexuality, pornographic & other undesirable elements dictated by the censorship board.

I dun wish to go into an argument or off-tangent (like I did with so many other threads here) with regards to the word 'censorship'. But lets try to stick on path this time.

We see bootleg (or 'pirated') anime, dramas for sale here. Most of it I believe, are parallel imports from China or Taiwan from obscure companies that do not have the proper licensing and original mastering from the originating country to have the authorisation for duplication and sale. Instead, these companies make use of copies of the original master or even from the original company's DVD/VCD to 'remaster', digitally remove any traces of the originating company and repackage the drama as 'released by XXX company'.

I'm personally not very sure how legal is this. But from my limited knowledge, licensed companies who are authorised by the film/anime makers to sell their films pay a certain amount back to the film/anime company (kinda like a royalty thing). But bootleg producers get every single cent from ur purchase and none of it goes back to the film/anime company.

Of cos, if u want original stuff, there's a price to be paid. If u guys want to be sure that u're buying the real deal, check out the packaging for obvious defects like typos, erratas, bad logo markings, etc. If u're really damn fussy about it, u can go online to see the the authorised retailers and distributors for the movie/anime. Some movie/anime companies have a long running deal with sales companies and lists them down.

The 'Buyer Beware' thing applies here since the question of pirated movies and parallel imports falls in a grey area.

based on what i have previously heard, the censorship board only request the distributors that the content matches the cover. It does not verify the content. Also, i think they only do selective inspection, which is normal.

The problem is with the sticker, most people will assume it's original. Instead of protecting the consumer, i think the censorship sticker is more like additional revenue to the censorship board and legitimatize the pirated dvds.

    Yes you're right.

And renting of pirated videotapes(!) or DVDs is not illegal in this country. Renting of non-censorboard approved material is. Whether the same applies to the sales of pirated videos I have no idea. I once called the censorship board to ask about this. If they have changed the rules since then, it's news to me.

Copyright fights are up to the copyright holders and their hacks to initiate. The censors here does not do the bidding for them.

I would say that most or even ALL the animes sold in those VCD shops are bootleg even with those censorship tags. I certainly loathe people making a profit out of other peoples work. so yeah, please stop buying them.

Actually rental (or letting for hire) of an infringing copy renders the person liable on conviction to max of S$10,000 per article (max S$100k) or 5 years jail or both.

Perhaps the law has changed then.

Well it seemed to be like this since at least 1998. Perhaps the censor officer gave you the wrong information

That's hard to say, if they are still awarding censorship stickers to allegedly pirated works.

BTW, my enquiry was around the same year you quoted. The reason why I remember quite clearly because I was surprised to see a censorship approval sticker on the crappy pirate video that my neighbourhood video shop loaned me, and I called the censorship board to make an enquiry. The officer specifically told me that it wasn't illegal under Singapore law to rent them out, and they have no jurisdiction over these things.

Now that we have signed so many free trade agreements with the US after that period, I do not know if the new IP laws has caused this to change or not.
