Attention all photographers,
It has been brought to our attention that some companies have been approaching some of our members offering to buy their photos with some very skewed terms and conditions.
Please be VERY CAREFUL, if you are being approached by anyone who tell you that your photos are good and marketable, and they are interested in buying your photos, under the following conditions:
"non-exclusive royalty free photos with full resale rights for an unlimited period of time"
Please read carefully:
non-exclusive = means you can still sell your photos to someone else (this term is ok)
royalty free = means as soon as you sign it over as royalty free, you will no longer receive a SINGLE CENT from any sales or re-sales to any other party, third party, fourth party, or any other sales downline etc.
full resale rights = means the buyer can resell your picture as many times or as many levels as they so wish. They can even sell it to someone else to be resold again. And because of the term above, you will NOT get a single cent.
unlimited period of time = forever and ever amen.
when you license your photos as royalty free photos or rights managed photos, you still own the copyrights of the photos.
The difference is, for royalty free photos, after that initial sale, you will cease to make any additional income from that sale or any downline sales of your picture.
If you let someone or a company (agency) manage your photos, they (agency) are only helping you to sell your photos and you will earn of royalties whenever any buyers buy your photos. And Agency always has use rights very clearly stated out on how the buyers can use the photos, for how long, and for distribution scale. They will also offer different pricing plans for buyers. The more wider and longer the use, the more expensive it will be, the more you as the photographer will get in return.
Photo buyers usually are the end user of your photos under standard license, they are not allow to resell your photos to third party. however, under extended license, photo buyers can buy your photos and use on their products, like print on T-shirt, posters, novelty, calenders, or create website template etc, and sell the products to their customers and clients. The photos can not be sold as a standalone product even under extended licensing.
Since you are still the rightful owner of your photos, you are entitled to earn royalties for licensing of your photos.
NOBODY should sell photos for 100% profit when photos does not belong to them.
So please beware when you are being approached with such terms. Be VERY VERY CAREFUL not to sign your rights away for a one time sale of your picture.
