Think so. I believe all major landmarks around the world are more or less copyrighted in some way. But I'm not sure the kind of licence it has.

True, but enter such a judgement create a precedent. This will be used by anyone who "feel" that their creativity infrinched just go to court and raise a case. No matter what happen now, this will be now a "Red tape" for anyone who is second in coming out of a creative ideal. The Court will not be judging in a creative way, or consider anything such as weather a personal has been doing it before or not.

A truly sad judgement passed by the court in England, let hope courts in the rest of the world take this kind of case with clear definition and enter judgment carefully with exceptional condition.

Other countries have different legal system where a single judge's decision is nothing more than this. And luckily other countries also have a different understanding about the nature of art and creativity. But putting this aside and looking at the 2 pictures .. I have to agree with the judge. It's too obvious to talk about coincidence and freedom of expression here.

Now you must be copy smart not to do xerox copy of concepts. Yes there is very little that is 100% original. You need to be able "transformerize" to make it look different enough to look "new"

It is a changing world out there. We have to start concerning a studio in Singapore being sue by an oversea studio for copying ideals, and company/person involve being summon oversea for trial....

Luckily I'm not in this line of business, but I do hope bros doing photography for living to take due care in producing their product, which I believe they will.

... in exactly the same way as many global companies have to do checks for technology being protected by patents - either before using the technology or before filing a new patent. It's nothing new. On the other hand: it is very very likely that similar or comparable concepts, ideas, styles, designs etc were and are constantly developed and used around the world without causing a huge legal fuss - simply because they are used on a small local scale and the people involved do not know that somebody else 10,000km way is doing something very similar. And all of them focus on the creative aspects, none of them has a big legal department ...
Finally, there is always the smarter option of starting a communication before starting a legal war.
